Trademark Checks Before a Crowdfunding Campaign

Check a campaign name, confirm ownership and reduce avoidable brand changes before publishing a crowdfunding page.

Why check a campaign name before launch?

A crowdfunding page can make a proposed brand public before a product is widely available. Backers may share the campaign, journalists may repeat the name and suppliers may begin printing it. Checking the name before launch preserves options while it is still practical to change the wording, artwork or packaging. Once a campaign is funded, a name change can confuse supporters and create new production costs.

Begin by writing down the exact campaign name, product name, logo and any tagline. Decide which element customers will remember and which is only descriptive campaign copy. A core product brand may need a different review from a temporary project title or reward-tier label. Keeping the distinction clear helps the team focus its time and budget.

Search the name and its close variations

Search the exact wording and likely variants, then compare sound, meaning and visual similarity in the markets where the product will be offered. Review related goods and services rather than counting exact matches. Check company names, domains, social handles and existing campaigns. A search engine or marketplace may reveal unregistered commercial use that does not appear in a trademark database.

The TMview search tool can help locate existing trademark records. Treat results as a screen, not as a promise that a filing will succeed. If a close mark appears for similar products, preserve the record and ask for a focused review before paying for advertising, packaging or manufacturing.

Confirm who owns the brand assets

Decide which legal entity will own the name and logo. The campaign creator, future operating company and manufacturer can be different parties. If a freelancer or agency designed the logo, collect the signed assignment or licence and confirm it covers the uses you need, including registration, adaptation and use in different markets. A payment receipt alone may not resolve every right.

Record how founders selected the name and who approved the final artwork. Keep original files, design contracts, approvals and the final version used on the campaign. If several founders are involved, document whether the company or an individual owns the brand, so a later departure or investment does not leave an unresolved gap.

Match the application to the product plan

Describe the product in ordinary business language. Identify the goods or services customers will receive and any near-term extensions that are commercially realistic. Avoid copying a competitor’s specification or adding unrelated categories “just in case.” The selected scope should make sense for the product and the company’s launch plan.

Territory is another decision. A campaign may attract backers from many countries, but that does not automatically mean the business needs protection everywhere. Identify where the product will be sold, shipped, licensed or supported. Compare that plan with the cost, timing and administration of national or EU-wide options. Do not promise a future SME FUND 2027 refund or percentage while the call’s terms are not confirmed.

Crowdfunding brand checklist

  • Fix the name and logo before campaign artwork is final.
  • Search similar marks and existing market use.
  • Confirm the applicant and collect creator agreements.
  • List the goods, services and territories that match the plan.
  • Save dated search notes, campaign drafts and final artwork.
  • Set a decision deadline before deposits and promotion begin.

Keep a dated copy of the published page and any supplier proofs. If a conflict appears, discuss the available options before making a public promise to backers. A preliminary search cannot guarantee registration or rule out every objection. This article is general information, not legal advice; check current procedures and funding terms before acting.
